1. Copyright Infringement Notification Procedure

To be effective under the DMCA, your notice must be a written communication that includes the following information:

  2. Identification of the infringing material that is claimed to be infringing and that is to be removed or access to which is to be disabled, along with sufficient information to locate the material (e.g., a URL or specific page on our website).
  3. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  4. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner of the copyrighted work or authorized to act on behalf of the owner.
  5. Your contact information, including your full legal name, mailing address, telephone number, and email address.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Upon receipt of a valid DMCA Notice, we will promptly investigate and take appropriate action, including removing or disabling access to the infringing material and notifying the user responsible.

2. Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification (“Counter-Notice”). To be effective, a Counter-Notice must include the following:

  1. Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled.
  2. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
  3. Your contact information, including your full legal name, mailing address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the federal court in your district or, if outside the United States, the jurisdiction of the courts located in India, and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
  5. A physical or electronic signature of the user submitting the Counter-Notice.

Upon receipt of a valid Counter-Notice, we may restore the removed content unless we receive notice from the original complaining party that they have filed a court action against you.

3. Repeat Infringer Policy

Litescaler reserves the right to terminate, suspend, or restrict access to our services for users who are found to be repeat infringers of copyrighted content. A repeat infringer is a user who has been subject to multiple valid DMCA Notices. We may also take additional measures, including legal action, as deemed appropriate.


4. False or Misleading Claims

Submitting false or misleading DMCA Notices or Counter-Notices can have serious legal consequences. Any person who knowingly misrepresents material information in a DMCA Notice or Counter-Notice may be liable for damages, including costs and attorneys’ fees, under applicable laws. Litescaler reserves the right to seek legal remedies for any abuse of this process.


5. Third-Party Content & Disclaimer

Litescaler provides hosting and other online services to customers, and we are not responsible for user-generated content uploaded to our platform. We do not actively monitor content and are not liable for any copyright infringement committed by our users. However, we will act promptly upon receiving valid DMCA Notices.
